Privacy Statement

At Arqen, we take your privacy seriously. This Statement of Privacy applies to the Arqen website and governs data collection and usage. Arqen is a general audience website, intended for users of all ages. Personal information of all users is collected, used and disclosed as described in this Statement of Privacy.

The Information We Collect

As an e-commerce website, Arqen collects personal information you give us such as your e-mail address, name, home or work address and telephone number. Like most websites, Arqen.com uses tracking software such as google analytics to assess trends in our traffic.

We are not responsible for the privacy statements or other content on websites outside of the Arqen website, including web sites that link to Arqen website.

Use of Your Personal Information

Arqen collects and uses your personal information to process product orders and deliver the products requested. If you subscribe to our mailing list, we will e-mail you a newsletter. It is possible that Arqen may also use personal information to inform you of other products or services available, but we will not sell or disclose your personal information to any other entity.

Arqen does not sell, rent or lease its customer lists, or any information therein, to third parties.

Arqen may access and/or disclose your personal information if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Arqen or the site; (b) protect and defend the rights or property of Arqen, including its website; or (c) act under exigent circumstances to protect the personal safety of users of Arqen or the public.

Transmission and Security

Arqen ensures that all sensitive personal information is transmitted over SSL encrypted connections. Personal information may be stored on secure Internet servers that host the Arqen website. Credit card numbers may be stored on secure servers but are never stored in clear text, always stored with public/private key encryption, accessible only by Arqen when provided with the proper credentials to do so.

1. Terms

By accessing this website, you are agreeing to be bound by these website Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trade mark law.

2. Use License

  1. Permission is granted to download one copy of the materials (information or software) on Arqen's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
    1. modify or copy the materials;

Further, Arqen does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

In no event shall Arqen or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Arqen's Internet site, even if Arqen or a Arqen authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Revisions & Errata

The materials appearing on Arqen's website could include technical, typographical, or photographic errors. Arqen does not warrant that any of the materials on its website are accurate, complete, or current. Arqen may make changes to the materials contained on its website at any time without notice. Arqen does not, however, make any commitment to update the materials.

Arqen has not reviewed all of the sites linked to its Internet website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Arqen of the site. Use of any such linked website is at the user's own risk.

7. Site Terms of Use Modifications

Arqen may revise these terms of use for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

8. Governing Law

Any claim relating to Arqen's website shall be governed by the laws of the Province of British Columbia without regard to its conflict of law provisions.

General Terms and Conditions applicable to Use of a website.

Limited Warranty

Warrenty on Acoustic Treatment Products

Arqen ("Arqen Sonic" or "we") warrants to the customer ("Buyer" or "you") that your Products, when used in accordance with the documentation furnished by Arqen, will be free of defects in materials and workmanship for the duration of the warranty. By default all products come with a one year parts and labor warranty from the date your Product ships. Warranty service claims must be made during the term of the warranty.

After your warranty expires with Arqen, you must deal directly with the Product manufacturer to obtain warranty service.

Shipping Warranty

If your product arrives with physical damage, immediately take pictures and report the damage to your shipping carrier and to us within 72 hours. Contact support@arqen.com if you need help filing a damage claim with the carrier. A damaged product does not constitute a refund (we will fix or replace it at our disgression).

For the first 30 days after the time of purchase, should we determine that your Product needs to be brought back for repair we will pay for shipping in both directions within Canada. After 30 days you are responsible for shipping charges and risk of loss or damage during transit to Arqen. Please use care when packaging a product to ship back to us.

Arqen will return repaired or replaced products to you, at its expense via regular ground service within Canada. You are responsible for shipping charges by all other methods and to all other destinations.

International Policies (Outside of Canada)

  • The buyer is responsible for all brokerage fees, taxes and tariffs.
  • Customers outside of Canada are responsible for all shipping costs, including those associated with warranty repairs or part replacements. Please contact us and see Limitation of Liability if you wish to repair a Product yourself.

Technical Support

During your warranty term, Arqen covers the labor costs for repairs performed by us. You must have your invoice number to obtain technical support.

Please visit our support page to submit a technical support ticket. The main method of communication is email, as this helps us to track technical issues.

Replacement Parts

If you report a failed component while under warranty, Arqen will repair or replace the component with a new or reconditioned part. If you are capable of performing a part replacement yourself, we can to send you the part as an advance RMA. A return shipping label will be included so that you can return the defective part to us. The advance RMA must be secured by credit card. If the defective component is not returned to us within 20 days of the time we ship the replacement, your credit card will be charged for the value of the part. Arqen is not responsible for damages resulting from improper installation of the new component.

Limitation of Liability

Except where prohibited by law, Arqen will not be liable for any loss or damage arising from accidents, disaster, misuse, or abuse of your product.

Any alterations, addition, improvements, attachments or repairs to the product by anyone other than Arqen will void your warranty if not authorized in writing by Arqen. Most modifications will be approved. Please email support@arqen.com to obtain clearance for any proposed modifications or repairs.

Sales Terms

Pricing & Availability

Prices shown on Arqen's website do not include shipping and handling. Prices do not include taxes and are in Canadian dollars, unless otherwise noted. All goods and services offered on the Arqen website are subject to availability.

Payment Options

We accept credit cards, Visa, MasterCard, money orders, personal or company checks. All payments made by check or money order will be shipped after the payment has cleared.

A credit card receipt/invoice will be included in each shipment.

We are unable to process card numbers sent via email. Please do not email your credit card number to us.

Shipping

Refused Deliveries

Refused deliveries will be returned to our Victoria, BC facility. No refund will be made until we have received and inspected the refused or returned product. It may take up to 45 days for the returned product to be processed for a refund.

Refund / Return Policy

Within the first 30 days after your order is shipped, you may return it for a refund minus shipping costs and a 15% restocking fee. You are responsible for the shipping costs to return a product. Please save your box! All returned products must be in as-new conditioning, in original packaging.

Before returning a product you must contact support@arqen.com to obtain an RMA number. RMA numbers are valid for 10 days, and you must ship the product back to us within this 10 day period. We will no longer accept the returned product if it has not been shipped within the 10 day RMA period.

No refunds will be made until the returned product has been returned to Arqen.

After we receive the returned product, please allow 1-2 weeks for the refund to show up on your credit card statement.

Please ship all returned products to our Victoria, BC facility.
